Terms of Service
These Terms of Service govern your enrolment, participation and use of services provided by Futuremakers Academy Pty. Ltd. (ABN 78 702 108 094), trading as Futuremakers Academy, based in Perth, Western Australia. By enrolling in a course, attending a program or using this website, you agree to these terms.
1. About These Terms
Futuremakers Academy Pty. Ltd. (ABN 78 702 108 094) provides education and training services, including short courses, workshops and professional development programs delivered in person in Perth, Western Australia and online. These terms form a binding agreement between you (the student, participant or enrolling organisation) and Futuremakers Academy Pty. Ltd.
If you enrol on behalf of an organisation, you confirm that you are authorised to bind that organisation to these terms.
2. Enrolment and Eligibility
To enrol in a course, you must submit a completed enrolment through our enrolment form or contact us directly. Enrolment is confirmed once we receive your completed details and applicable payment or approved purchase order.
You must provide accurate and current information, including your name, contact details and any prerequisites requested for specific courses. We may decline or cancel an enrolment if information provided is false, misleading or if a participant does not meet stated course prerequisites.
3. Fees and Payment
All course fees are quoted in Australian dollars (AUD) and include GST where applicable. Fees must be paid in full prior to the course commencement date unless an alternative payment arrangement has been agreed in writing.
Where an organisation enrols participants on a purchase order basis, payment is due within 14 days of invoice. Late payments may result in the suspension of access to course materials, resources and certification until the account is settled.
4. Cancellations, Transfers and Refunds
If you wish to cancel or transfer your enrolment, please notify us in writing as early as possible by emailing ceo@futuremakersacademy.site. Our standard arrangements are:
- Cancellation more than 14 days before the course start date: full refund of fees paid, or a free transfer to a future course date.
- Cancellation within 14 days of the course start date: a transfer to a future course date, or a refund of fees paid less a 20% administration fee.
- Cancellation on or after the course start date, or non-attendance: no refund is payable, however a substitute participant may attend in your place at no extra cost.
- If Futuremakers Academy cancels or reschedules a course: you will be offered a full refund or a free transfer to the next available date.
These arrangements apply in addition to, and do not limit, your rights under Australian Consumer Law as set out in Section 5.
5. Australian Consumer Law โ Your Consumer Guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law.
You are entitled to a replacement or refund for a major failure with our services and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
Where the Australian Consumer Law applies and cannot be excluded, our liability for a failure to comply with a consumer guarantee is limited, to the extent permitted by law, to supplying the services again or paying the cost of having the services supplied again.
6. Course Materials and Intellectual Property
All course materials, workbooks, slides, recordings, templates and other resources provided by Futuremakers Academy remain the intellectual property of Futuremakers Academy Pty. Ltd. or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use course materials for your own learning and professional development.
You must not reproduce, redistribute, resell, publish or share course materials, in whole or in part, without our prior written consent. Group enrolments and corporate licences are available on request via ceo@futuremakersacademy.site.
7. Student Conduct and Participation
All participants are expected to behave respectfully towards facilitators, staff and fellow students. Disruptive, abusive, discriminatory or unsafe behaviour may result in removal from a course without refund, at our reasonable discretion.
Participants are responsible for their own attendance, punctuality and completion of any required assessments. Where a minimum attendance or assessment standard applies to earn a certificate of completion, this will be clearly communicated at enrolment.
8. Certification
Where a participant meets the attendance and assessment requirements of a course, Futuremakers Academy will issue a certificate of completion. Certificates confirm participation in and successful completion of our own programs and do not represent a nationally recognised qualification unless expressly stated otherwise in writing at the time of enrolment.
9. Limitation of Liability
To the fullest extent permitted by law, and except as required by the Australian Consumer Law, Futuremakers Academy Pty. Ltd. is not liable for any indirect, incidental, special or consequential loss or damage arising from your participation in a course or use of this website.
Where liability cannot be excluded, our total aggregate liability arising out of or in connection with the services is limited to the fees you paid to us for the relevant course.
We do not warrant that course content is suitable for every individual circumstance. Course content is general in nature and does not constitute professional, financial, legal or medical advice.
10. Health, Safety and Accessibility
For in-person delivery, participants must comply with all reasonable safety directions given by our facilitators and venue requirements. If you have accessibility needs, medical conditions or dietary requirements relevant to your participation, please let us know at enrolment so we can make reasonable adjustments.
11. Website Use
